Prospecting Permit ID: X2011335 – First Round Deficiency Response: Dear Mr. Yde: The following is in response to your “First Round Deficiency Response” dated June 30, 2011 for American Power Corporation’s Prospecting Permit Application ID: X2011335. Item 1. Section B1.12. Method of plugging holes: A discussion of all the requirements for plugging holes as required by ARM 17.24.105 (C) (i), (ii) and (iii) has been added to the revised Prospecting Permit “Short Form” dated July 5, 2011. Item 2. Section B2. 1A. Listing of Sections affected by the proposed drilling program. A statement has been added to this section stating that all the affected sections are shown on the “Prospecting Permit Map” that was included as part of the Permit submittal. Item 3. Section B2. G. Documentation has been provided showing Malmstrom Air Force Base has reviewed the proposed drill hole locations, and have stated that there are no conflicts. A copy of the E-mail from Malmstrom Air Force Base is attached with this deficiency response. Item 4. The “Short Form” under Section C2 has been modified to show the initial Bond amount to show a dollar value of $62,556 instead of a numerical amount of 62556. However, the “Short Form which I downloaded from your Web Site won’t all me to show all three amounts in a “dollar” format. When I attempt to put all three figures ($59,956.00 +$2,600.00 for a total of $62,556.00), the Short Form changes some or all of the figures back to a decimal format.

Item 5. The one drill hole with the designation “M”, indicates that this particular hole will be tested for Methane. This hole is also a core hole, which is described on the “Short Form” under Section B2. 1A. If the above information provides the additional information you requested in your 1st Round Deficiency Response dated June 30th, 2011, please notify me and I will send you a new Notarized Short Form with original signatures.
